    A clear incoming and outgoing inspection protects both tenants and landlords. Here's how deposits work under the Rental Housing Act.

    In South Africa, rental deposits are regulated by the Rental Housing Act. The deposit is held by the landlord or agent and must be refunded at the end of the lease, less any reasonable deductions for damage.

    An incoming inspection is conducted at the start of the lease and documented in writing. An outgoing inspection is done at the end. The difference between the two determines any deductions.

    Normal wear and tear is not the tenant's responsibility. Damage beyond wear and tear, such as broken windows or stained carpets, may be deducted from the deposit.
